Indeed it is silly.

Among friends I would house-rule the Cauldron to have Ld 8 on death of the character. But in a competitive environment you generally have to live with the written stat line.

I agree that the stuff is obsolete. The new plastic models are so well engineered that you don't need to worry much about gap filling. 1. I would say that re-rolls to hit in combination with murderous prowess is where the big difference is. Yes they are very good. My issue is that there are powerful units in other armies that get off very light. No.

What matters is the whether the models you are attacking have ASF (or high initiative). Other models in the combat don't matter for that purpose.
